1. Acceptance of Terms
By accessing or using PyCloud ("the Service", "we", "us", or "our"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree with any part of these terms, you must not use the Service.
These terms constitute a legally binding agreement between you and PyCloud. You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account.
2. Accounts & Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate, current, and complete information when registering.
- Keep your login details secure and notify us immediately of any unauthorized use.
- Be solely responsible for the content, code, and data you deploy through the Service.
- Ensure that your use of the Service complies with all applicable laws and regulations.
3. Acceptable Use
You agree not to use the Service to:
- Violate any law, regulation, or third-party right.
- Distribute malware, engage in hacking, or attempt to compromise the security of the Service or other users.
- Host, transmit, or process unlawful, abusive, defamatory, or infringing content.
- Overuse shared resources in a way that degrades performance for other users (resource abuse).
- Resell, reverse-engineer, or attempt to circumvent plan limits or metering.
4. Suspension & Termination
We reserve the right to suspend or terminate your subscription, account, or access to the Service at any time, with or without prior notice, if we determine, in our sole discretion, that you have breached these Terms or engaged in activity that is harmful to the Service, other users, or third parties.
Malicious or suspicious activity: Any malicious, abusive, or otherwise suspicious activity by a user — including but not limited to attempts to exploit, attack, or unauthorized access of the platform or other accounts — will lead to immediate suspension of the subscription and may result in permanent termination of the account, forfeiture of any associated data, and, where appropriate, referral to the relevant authorities.
Upon termination, your right to use the Service ceases immediately. We are not liable to you or any third party for any suspension or termination carried out under this section.
5. Trial Plan
PyCloud may offer a free trial plan ("Trial Plan") with limited resources intended for evaluation purposes. The Trial Plan is provided as-is and may be subject to additional restrictions at any time.
Changes to the Trial Plan: The features, limitations, availability, runtimes, and any other aspect of the available Trial Plan can change at any time, with or without notice, and at our sole discretion. We make no commitment to maintain any particular configuration, entitlement, or duration of the Trial Plan.
We may modify, suspend, or withdraw the Trial Plan entirely for any or all users at any time.
6. Service Availability & Changes
The Service is provided on an "as available" basis. We strive for high availability but do not guarantee uninterrupted or error-free operation. We may perform maintenance, introduce new features, or modify or discontinue parts of the Service at any time.
Pricing, plan features, and resource limits for paid plans may change in accordance with the notices provided at the time of any such change. Changes to paid plans will not retroactively alter the terms of an already-purchased, fixed commitment where applicable.
7. Intellectual Property
The Service, including its software, design, branding, and documentation, is owned by PyCloud or its licensors and is protected by applicable intellectual property laws. You retain all rights to the code and content you upload, and you grant us a limited license to host, process, and transmit it solely as necessary to operate the Service for you.
8. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, PyCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue arising from your use of or inability to use the Service. You are solely responsible for maintaining backups of your own data.
9. Modifications to These Terms
We may revise these Terms & Conditions from time to time. Where changes are material, we will endeavor to provide notice (for example, by updating this page or via email). Your continued use of the Service after any changes take effect constitutes acceptance of the revised terms.
